TheMarketingConsultant.com ("the Service," "we," "us," or "our"), operated by Maniac Digital, LLC, a Utah limited liability company doing business in the District of Columbia, is committed to protecting your privacy. This Privacy Policy explains how we collect, use, store, and protect your information when you use our Service.

Account Information: When you create an account, we collect your name, email address, and payment information (processed through our third-party payment provider, not stored by us).

4. Third-Party AI Processing

Your queries and inputs are processed through Anthropic's Claude commercial API to generate responses. This means:

  • Your inputs (questions, business data, metrics you share) are transmitted to Anthropic's servers for processing.
  • Under Anthropic's commercial API terms, your inputs and outputs are NOT used to train Anthropic's AI models by default.
  • Anthropic may retain data briefly for abuse monitoring and platform safety in accordance with their commercial terms.
  • Maniac Digital, LLC does not control Anthropic's data handling beyond what is specified in their commercial API terms.

We do not use your specific business data to train any external AI models. However, because your data is processed through Anthropic's infrastructure, we cannot guarantee data handling beyond what Anthropic's commercial terms provide. We strongly advise against inputting highly sensitive information (Social Security numbers, bank account numbers, credit card numbers, passwords, protected health information, trade secrets) into the Service.


5. Feedback and Rating Data

If the Service includes feedback or rating features (such as thumbs up/down or written feedback):

  • Feedback you submit may be shared with Anthropic and is subject to Anthropic's feedback handling policies.
  • Anthropic de-links feedback from user and customer IDs before using it.
  • Anthropic may use feedback to analyze service effectiveness, conduct research, and train AI models as permitted under applicable laws.
  • Feedback data is handled differently from regular conversation data. We will clearly disclose this at the point of feedback collection.
  • Submitting feedback is entirely optional.

6. Data Shared with Third Parties

We may share limited information with the following categories of third parties:

  • AI Model Provider (Anthropic): Your queries are processed through Anthropic's Claude commercial API as described in Section 4 above.
  • Payment Processors (e.g., Stripe): To process subscription payments. We do not store your full credit card information.
  • Analytics Providers: We may use analytics tools to understand Service usage patterns. This data is aggregated and does not identify individual users.
  • Legal Compliance: We may disclose information if required by law, regulation, legal process, or governmental request, including requests from District of Columbia or federal authorities.

We do NOT sell, rent, or trade your personal information to third parties for marketing purposes.


7. Data Retention

Account Data: Retained for the duration of your account plus 12 months after account closure, after which it is deleted.

Conversation/Chat Data: Retained for 90 days, then automatically deleted. Note that data transmitted to Anthropic during your session is subject to Anthropic's commercial retention policies and cannot be deleted by Maniac Digital, LLC.

Payment Data: Retained as required by applicable federal and state tax and financial regulations (typically 3-7 years depending on jurisdiction).

Feedback Data (if applicable): Retained by Maniac Digital, LLC for 90 days. Feedback shared with Anthropic is subject to Anthropic's retention policies, which may differ.

Users may request deletion of their conversation history at any time by contacting [email protected]. Deletion requests will be processed within 30 days. Note that data already transmitted to Anthropic is subject to Anthropic's retention policies and cannot be deleted by Maniac Digital, LLC.


8. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your information from unauthorized access, alteration, disclosure, or destruction, consistent with District of Columbia data security requirements. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

In the event of a data breach affecting your personal information, we will notify affected users and the appropriate District of Columbia authorities in accordance with the D.C. Security Breach Notification Act (D.C. Code § 28-3851 et seq.).


9. Your Rights

You have the following rights regarding your personal data:

  • Access: Request a copy of the personal data we hold about you.
  • Correction: Request correction of inaccurate personal data.
  • Deletion: Request deletion of your personal data, subject to legal retention requirements and the limitations described in Section 7. Note that data transmitted to Anthropic is subject to Anthropic's retention policies.
  • Portability: Request your data in a structured, commonly used, machine-readable format.
  • Opt-Out: Opt out of non-essential data collection and marketing communications.

10. Children's Privacy

The Service is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected data from a child under 18, we will take steps to delete that information promptly.


11. California Residents (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act and California Privacy Rights Act, including:

  • The right to know what personal information we collect, use, and disclose.
  • The right to request deletion of your personal information.
  • The right to opt out of the sale or sharing of personal information. We do not sell or share personal information as defined by the CCPA/CPRA.

12. District of Columbia Residents

In accordance with the District of Columbia Consumer Protection Procedures Act (D.C. Code § 28-3901 et seq.) and the D.C. Security Breach Notification Act (D.C. Code § 28-3851 et seq.):

  • We will not engage in deceptive trade practices in connection with the collection or use of your personal data.
  • In the event of a security breach, we will notify affected DC residents and the Office of the Attorney General for the District of Columbia as required by law.
  • You may file complaints regarding our data practices with the Office of the Attorney General for the District of Columbia.

13. International Users

If you are accessing the Service from outside the United States, your data may be transferred to and processed in the United States, including processing by Anthropic's infrastructure. By using the Service, you consent to this transfer and processing. Data protection laws in the United States may differ from those in your jurisdiction.

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on our website and updating the "Last Updated" date. For material changes, we will also notify you via email. Continued use of the Service after changes constitutes acceptance of the updated policy.
